2.3. Data required to register on the Website and create your NY Lab account

On the "Login/Register" section of the Website, the User is required to provide specific personal data to create their own account on the Website and to make Product purchases without having to enter their contact and delivery details each time:

2.4. Data required to register on the Website and purchase products: Personal data and contact details

You can purchase NY Lab products ("Products") on the Website in two ways: i) by accessing the appropriate area and registering for a personal account or (ii) as a guest without having to register on the Website. For (i), after providing the required data to register on the Website as noted in the previous section 2.3, Users are required to provide additional contact details (i.e. delivery and billing address) as shown in the table below; For (ii), to purchase a Product the non-registered User is required to provide specific personal data - as shown in the following table - in order to complete an online Product purchase:

2.5. Data provided by Users to receive the newsletter, information and updates from NY Lab

The User can provide specific personal data on the Website home page, the "Login/Register" section or at the end of the Product purchase procedure to sign up for the NY Lab newsletter and receive information and updates about Products. To sign up for the newsletter the following data is needed: email address and gender.

Providing this personal data is voluntary: if Users do not provide it, they can still browse the Website but will not receive updates on NY Lab's activities and products through the newsletter service.

 

2.6. Data provided by Users when applying for vacancies: voluntarily provided personal data and contact details

On the "Work with us" section of the Website, Users are required to provide specific personal data when submitting a job application to NY Lab to allow Leading Brands SA to evaluate their professional profile:

3. PROCESSING PURPOSES

The personal data of Website Users ("Data") may be processed for the following purposes.

3.1. Browsing data

Browsing data is used: (i) to monitor the Website is working correctly, (ii) anonymously and in an aggregate form, for statistical purposes related to understanding how the Website is used by Users, to improve access and increase its attractiveness, as well as (iii) to detect any technical issues as soon as possible.

The information is automatically collected by the Website and does not require any User action.

the legal basis of this processing is NY Lab's legitimate interest in improving its digital services, especially in relation to the use of the Website, and is compatible with the position of the data subjects as: (a) the monitoring of the Website operation and statistical data related to its use does not involve direct identification; and (b) the interest of the Company is reasonable in relation to Users, who will therefore be able to use a website that is performs well and is optimised.

3.2. Responding to User requests

Data provided by Users when completing the "Contact us" form or via the email address and telephone numbers, will be processed to respond to Users' requests sent to NY Lab.

The legal basis of this processing is the need to carry out pre-contractual and contractual measures to meet the User's request, and to fulfil the related legal obligations.

The provision of data is necessary to allow NY Lab to receive and respond to Users' requests: therefore, failure to provide such data will make it impossible for NY Lab to comply with the User's requests.

3.3. Website account registration

Data provided by Users when completing the form in the "Login/Register" section of the Website will be processed to allow the User (i) to access their private area; (ii) to purchase Products without having to enter contact and delivery details each time; and (iii), with express consent given by the User, to receive the newsletter and stay up to date on NY Lab news.

The legal basis for this processing is the need to carry out the pre-contractual and contractual measures to meet the User's request, and to fulfil the related legal obligations and, the legal basis for processing for sending and receiving the NY Lab newsletter is the express consent given by the User directly through the Website.

The provision of data is necessary to allow Users to register on the NY Lab Website. Failure to provide the data will not prevent the User from browsing the Website.

3.4. Product Purchases

Data collected during Product purchases will be processed for the sale and delivery of the Products purchased by the User.

In this situation, the data collected may be communicated:

  • to public and private subjects involved in the related organisational activities and management of Product purchase and delivery and/or suppliers of ancillary and necessary services (e.g. couriers, logistics company, etc.). These subjects will process the data as an autonomous data controller or processor, depending on the situation, under a specific written assignment given to them by NY Lab.

The legal basis of this processing is the need to carry out pre-contractual and contractual measures to meet the User's request, and to fulfil the related legal obligations.

The provision of data is necessary to complete Product purchases: therefore, in the event of refusal or failure to provide the requested data - including the data required to register for an account on the Website - it will not be possible for NY Lab to comply with the User's requests

3.5. Subscribe to the newsletter and receive commercial messages

The data collected (i) when a request is made to subscribe to the newsletter service or (ii) during Product purchases, subject to the User's consent, will be processed to send information and commercial messages on NY Lab's activities and products.

In this situation, the data collected may be communicated:

  • to companies providing ICT services for managing the newsletter sending platform (i.e. ContactLab S.p.A.).

The legal basis of this processing is the express consent given by the User directly through the Website.

The provision of data is necessary to complete the registration for, and take advantage of, the newsletter service: therefore, refusing or failing to provide the requested data will make it impossible to receive the NY Lab newsletter.

The User can cancel their subscription to the newsletter service at any time, following the procedure noted at the bottom of each newsletter or by sending a specific message to NY Lab at the addresses indicated in the following point 8.

3.6. Applying for job vacancies

The data collected when you send your curriculum vitae, by completing the form in the "Work with us" section of the Website, will be processed for the assessment of the job application submitted by the User and to start the selection process aimed at establishing an employment relationship with NY Lab.

The legal basis of this processing is the need to carry out pre-contractual and contractual measures to meet the User's request, and to fulfil the related legal obligations.

The provision of data is necessary to allow the assessment of the User's professional profile: therefore, failure to provide the requested data will make it impossible for NY Lab to comply with the User's request.

 

The data collected by NY Lab for the purposes referred to in the preceding point3 (from point3.1 to point3.6), hereinafter jointly the "Data".

 

4. PROCESSING METHODS

Data will be processed both in paper form and by electronic, ICT or automated means, using systems that ensure protection, security and confidentiality. Data will be stored by NY Lab on the company's servers and will be processed by subjects to whom NY Lab has given appropriate operating instructions with particular reference to the adopted security measures.

Furthermore, NY Lab has adopted specific and adequate logical, legal, organisational and technical security measures to prevent the loss of the Data, its illicit or unauthorised use and unauthorised access to it.

 

5. COMMUNICATION OF DATA and DATA RECIPIENTS

Data may be made known to NY Lab employees and/or collaborators, specially designated as persons authorised to process (for example individuals in charge of administrative, accounting and ICT systems).

User Data may also be disclosed to third parties who provide ancillary services or services related to the management of the Website, its functionalities or which are necessary for carrying out the e-commerce service. In this case, the third party Data recipients - autonomous data processors or duly designated data controllers - belong to the following categories:

A. subjects who carry out, on behalf of or for NY Lab, tasks of a technical and organisational nature or of professional assistance/consulting, in particular accounting, legal and notary consultants, delivery and logistics companies for the management Product purchases (i.e. the delivery company SwissPost), companies authorised by NY Lab to repair products purchased by customers (e.g. workshops, etc.);

B. companies that supply software and ICT services, managers of the NY Lab Website (i.e. Keros Digital SA for management of the NY Lab website and the area reserved for registered customers; ContactLab S.p.A. for the management of the newsletter sending platform; SaleCycle for the management of marketing automation activities).

 

6. DATA DISSEMINATION

The data will not be disseminated.

 

7. LIMITED STORAGE PERIOD

Data collected and processed by NY Lab, for the purposes identified in the previous point3, may be stored in a form that allows the identification of the User for the period necessary to achieve the processing purposes and, in particular:

  • Browsing data is not kept for more than 24 hours and is deleted immediately after being aggregated (except for cases related to identifying crimes by the competent judicial authority);
  • for the processing referred to in point 2 to verify the User's requests, data provided by the User is kept for up to 12 months after receipt of the request;
  • for the processing referred to in point 3 to receive the User's request to register on the Website, data is kept up to 24 months following the last personal account access; where the User has not logged on for 24 months, we will give them 2 months notice that their Data will be deleted and they will no longer have access to the reserved area of the NY Lab Website;
  • for the processing referred to in point 4 to check the User's requests to purchase the Products offered for sale by NY Lab, the data is kept for the entire duration of the relationship and for the following period necessary to fulfil related tax and accounting obligations, as well as to ensure the legal protection of NY Lab's rights;
  • for the processing defined in point 5, i.e. for sending newsletters with informative or commercial content, for a period of 24 (twenty-four) months from the last contact;
  • for the processing referred to in point 6, i.e. to assess the User's job application, data is kept for no more than 12 (twelve) months from the date of receipt of the application if the profile does not meet NY Lab's requirements; or, where a contractual, work, collaboration or internship relationship is established, data is kept for the entire duration of the relationship and for the subsequent period necessary to fulfil the related legal tax and accounting obligations.

Data may be stored for longer periods where necessary to fulfil legal obligations, or for the protection of NY Lab's rights, until the expiry of the related limitation period.

 

8.USER RIGHTS AND CONTACT DETAILS

The User may, at any time and to the extent that the rights are applicable: (I) obtain confirmation of the existence or not of personal data concerning them; (II) request access to their personal data; (III) request the rectification, erasure or processing restriction of personal data; (IV) oppose the processing, or withdraw consent to the processing, without effecting the lawful basis of the processing based on consent given before the withdrawal; (V) receive in a structured, commonly used and readable by an automatic device format, personal data concerning them provided to NY Lab, as well as request that such data be sent to another data controller (right to personal data portability); (VI) make a complaint or appeal to the competent judicial authority for the protection of their personal data.
